It’s important to make sure the report form provides not only currently registered and pending marks but also abandoned, canceled and expired trademarks and service marks, both identical and similar to your proposed mark.
The company should also conduct various wild card searches, where they not only search your exact name, but variations of the mark. All marks that they find similar to your proposed mark should be investigated so they can supply you with full details on those marks: owner of mark, status, goods/services, registration number, date of registration and contact address.
There should also be a brief summary letter, explaining the basic results that were found. Note that this brief summary is NOT a legal opinion letter. A search does not come with an attorney opinion unless that is specified.
A good quality search should be conducted across all international classes as conflicts can easily occur between them. The legal litmus test is a “likelihood of confusion to the general public”. You cannot assume that just because someone’s mark is in a different class, that it’s available.
